Terms of Service

Effective date: September 29, 2026

These Terms govern your use of MalcolmToddle at malcolmtoddle.com (the "Service"), operated by Summit Development. By using the Service you agree to these Terms. If you don't agree, don't use it.

Fan project & non-affiliation

MalcolmToddle is an independent, fan-made game. It is not affiliated with, endorsed by, or sponsored by Malcolm Todd, Columbia Records, or their representatives. All artist names, song titles, and recordings belong to their respective owners. Song previews are streamed from Apple's iTunes service and are not hosted by us. The name and music are used to identify the songs for the guessing game only.

Eligibility

You must be at least 13 years old to use the Service. By using it, you confirm that you are. If you're under 18, you need a parent or guardian's permission to make a purchase.

Your account

• You're responsible for keeping your login secure and for activity under your account.
• Provide accurate information. Don't impersonate others or pick a display name that's offensive or infringing.
• Your display name, stats, achievements, equipped cosmetics and profile photo are public on the leaderboard and your profile page.
• Profile photos: only upload a photo you have the right to use. No nudity or sexual content, violence, hate symbols, harassment, or photos of other people without their permission. You keep ownership of your photo and give us permission to display it on MalcolmToddle. Photos reported by several players are hidden automatically, and we may remove any photo or suspend accounts that break these rules.
• You can delete your account at any time from the Preferences page.

Acceptable use

Don't:

• Cheat, automate play, script requests, or otherwise manipulate scores, the leaderboard, or matchmaking.
• Attempt to access other users' data or accounts, probe or attack the Service, or bypass security.
• Copy, scrape, resell, or redistribute the Service or its content.
• Use the Service unlawfully or to harass others.

We may suspend or remove accounts that break these rules or abuse the game.

The game is provided "as is"

We work to keep the Service running, but we provide it "as is" and "as available," without warranties of any kind. We don't guarantee it will be uninterrupted, error-free, or that scores or availability will be preserved. Features, songs, and scoring may change.

Limitation of liability

To the fullest extent allowed by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. The game is free to play; optional purchases are cosmetic only.

Purchases, Supporter and cosmetics

• Everything for sale is cosmetic. Purchases change how your name and profile look. They never affect Todd Points, ranks, matchmaking or scoring.
• Payments are processed by Stripe. Prices are shown in US dollars before you pay. Where Stripe acts as the seller of record, Stripe's terms also apply to the payment and it handles any sales tax.
• Limited-time items (like the Halloween drop) are only sold during their event and leave the shop when it ends. If you get one, you keep it like any other cosmetic.
• Supporter is a subscription that renews automatically every month at the price shown at checkout (currently $1.99/month) until you cancel. You can cancel anytime from the Shop with "Manage or cancel"; you keep Supporter perks until the end of the period you've paid for, and you won't be charged again. If we ever change the price, we'll tell you in advance and you can cancel before it applies.
• Cosmetic items are a one-time purchase of a personal, non-transferable license to use the item on MalcolmToddle. They have no cash value and can't be sold, traded or exchanged for money.
• Refunds: purchases are final and non-refundable, except where the law requires otherwise. If you were charged by mistake or didn't receive what you paid for, email hello@malcolmtoddle.com and we'll fix it. Nothing here limits any refund or cancellation rights you have under the law where you live.
• If we suspend an account for cheating or breaking these Terms, its cosmetics and Supporter perks may be removed, to the extent the law allows. If we shut the Service down, we'll cancel active subscriptions so nobody is billed again.

Gems and Mystery Boxes

• Gems are a virtual currency used only on MalcolmToddle. You can earn them by playing (for example, finishing the daily song or winning duels), by watching an optional ad where offered, or buy them in packs. Gems have no cash value, can't be exchanged for money, and can't be sold, traded or transferred to anyone else.
• Mystery Boxes cost gems and give one random cosmetic item. The odds of each rarity are shown in the Shop before you open a box, along with every item a box can contain. A box never gives an item you already own. Every box item is cosmetic only and never affects Todd Points, ranks, matchmaking or scoring.
• Mystery Boxes aren't offered in places where the law doesn't allow them (currently Belgium), and we may turn them off anywhere to comply with the law.
• 2x Gems is a one-time purchase that doubles the gems you earn from playing and ads, for as long as your account and the Service exist. It doesn't double purchased gems.
• Gem packs and the 2x boost are final once delivered and are non-refundable, except where the law requires otherwise. Unused gems are lost if you delete your account, or if we suspend it for cheating or abuse (to the extent the law allows). We may change how many gems things cost or pay, with notice for changes that reduce what you already own.
• If you're under 18, you need a parent or guardian's permission before buying gems or opening Mystery Boxes.

Merch

Any merchandise is sold through a separate store hosted by Fourthwall. Purchases, shipping, and returns are handled there under Fourthwall's terms, not these.

Affiliate links

Some links are affiliate links (including Amazon and Apple). We may earn a commission from qualifying purchases made through them. As an Amazon Associate I earn from qualifying purchases. Purchases are between you and the seller.

Changes and termination

We may update these Terms; continued use after a change means you accept it. We may modify, suspend, or discontinue the Service at any time. You may stop using it and delete your account whenever you like.
